Terms and Conditions of Use
Effective Date: December 07, 2025
These Terms of Use (“Terms”) govern access to and use of the Race Planner (“Service”), a digital tool designed to assist yacht clubs and sailing organizations (“Clubs”) in planning, administering, and managing sailboat racing activities. By accessing or using the Service, the Club agrees to be bound by these Terms.
1. Purpose of the Service
The Race Planner is provided as a race management tool to support Clubs in:
- Creating and organizing sailboat races
- Managing course data, marks, and race schedules
- Maintaining PHRF or other handicapping information
- Assisting race committees and handicapping committees with administrative tasks
The Service is not a race authority, governing body, or rule-setting organization. It is a utility provided to Clubs to aid—not replace—their own race management processes, responsibilities, and decisions.
2. Club Responsibilities
Each Club using the Service agrees that it is solely responsible for:
2.1 Club Data Ownership & Management
- Entering, updating, and maintaining its own data within the Service
- Ensuring the accuracy of course information, marks, race schedules, handicaps, and boat data
- Managing its own handicapping committee inputs
- Managing its own race committee decisions
- Ensuring data is kept current, correct, and compliant with applicable rules
The Service does not validate or guarantee the accuracy of any data entered by Clubs.
2.2 Compliance With Racing Rules
Clubs are fully responsible for ensuring their races conform to:
- The World Sailing Racing Rules of Sailing (RRS)
- Any applicable national prescriptions
- Any local fleet rules, one-design class rules, or PHRF guidelines they adopt
- All applicable safety, permitting, and regulatory requirements
The Service does not advise, validate, or enforce rule compliance.
2.3 Decisions About Racing
Clubs retain complete discretion and responsibility for:
- When and where to conduct races
- Determining whether conditions are safe
- Setting courses and modifying them
- Applying handicaps or scoring systems
- Cancelling, postponing, or abandoning races
The Service does not make or override racing decisions.
3. Access & Security
3.1 Club-Specific Accounts
Each Club receives access credentials unique to that Club.
Clubs agree to:
- Keep their access credentials secure
- Regularly update authorized administrators
- Remove users who should no longer have access
3.2 No Sharing With Other Clubs
Access is provided for one Club only.
Clubs may not share their Race Planner access, credentials, or data infrastructure with:
- Other yacht clubs
- Regional sailing associations
- Independent fleets
- Individuals outside the Club’s authorized race or handicapping committees
Unauthorized sharing may result in suspension or permanent loss of access.
4. Data Storage & Availability
The Service uses third-party infrastructure (including some Google services or other platforms). While reasonable efforts are made to maintain uptime and reliability, the Service:
- Does not guarantee uninterrupted availability
- May undergo maintenance or experience outages
- Is provided on an “as-is” and “as-available” basis
Clubs are responsible for maintaining external backups of any mission-critical information.
5. Limitations of Liability
To the fullest extent permitted by law:
- The creator(s) and administrator(s) of the Service are not liable for any errors in course setup, scoring, handicaps, scheduling, or race management arising from Club-entered data.
- The Service is not liable for race incidents, safety decisions, protests, scoring disputes, or governance issues.
- The Service does not assume responsibility for outcomes resulting from Club use, misuse, or reliance on the tool.
- Clubs acknowledge that all racing decisions—including safety and rule compliance—remain exclusively the responsibility of the Club.
The Service is intended as a tool, not a guarantee of accuracy, compliance, scoring correctness, or race safety.
6. Acceptable Use
Clubs agree not to:
- Attempt to exploit, copy, reverse-engineer, or redistribute the system
- Tamper with or modify backend code or database structures
- Use the Service for purposes other than managing their own Club’s races
- Introduce malicious scripts, bots, or abusive automated requests
- Upload harmful, inappropriate, or unlawful content
Violation of acceptable use may result in suspension or termination of access.
7. Updates & Modifications
The Service may be updated, changed, or improved at any time.
Clubs will be notified of major changes, but continued use of the Service signifies acceptance of updated Terms.
8. Termination of Access
Access may be terminated or suspended if:
- A Club violates these Terms
- A Club compromises system integrity or security
- A Club engages in unauthorized sharing with other organizations
- The Service undergoes re-structuring or shutdown
Clubs may voluntarily discontinue use at any time.
9. Governing Law
These Terms are governed by the laws of the State of Texas unless superseded by other applicable jurisdictional requirements.
10. Acceptance
By accessing or using the Race Planner, the Club acknowledges and agrees to these Terms of Use.
If a Club does not agree to these Terms, it must discontinue use of the Service immediately.
